These Terms and Conditions apply to your access to and use of the Liztty website, mobile application, web dashboard, booking tools, job management tools, communication tools, payment tools and related services.

By accessing or using Liztty, creating an account, accepting an invitation to a business account, booking a service, accepting a job, sending a quote, communicating through the platform or otherwise using the platform, you agree to these Terms.

If you use Liztty on behalf of a company, business, partnership, trust, organisation or other entity, you confirm that you are authorised to bind that entity to these Terms.

1. Definitions

In these Terms:

"Liztty", "we", "us" or "our" means the operator of the Liztty platform.

"Platform" means the Liztty app, website, web dashboard, booking system, job management system, communication tools, quote tools, customer management tools, payment tools and related services.

"User", "you" or "your" means any person or entity using Liztty, including Customers, Account Holders, Business Users, Team Members, Providers, contractors, staff, administrators, visitors and invited users.

"Account Holder" means the person or business that creates, owns or controls a Liztty account.

"Business User" means a business, sole trader, company, contractor or organisation using Liztty to manage jobs, customers, bookings, quotes, staff, providers, payments or communications.

"Team Member" means a staff member, contractor, admin assistant, dispatcher, call centre agent, technician, installer, field worker or other person invited to access an Account Holder's Liztty account.

"Customer" means a person or organisation who requests, books, receives, pays for or communicates about a service through Liztty.

"Provider" means a contractor, technician, installer, handyman, cleaner, driver, service provider, tradesperson or business that accepts or performs jobs through Liztty.

"Job" means any service request, booking, task, quote, visit, appointment, work order, delivery, installation, repair, assembly, cleaning, inspection or related service managed through Liztty.

"Job Data" means information relating to a Job, including customer details, addresses, phone numbers, photos, notes, booking times, job descriptions, quotes, invoices, payment status, communications, completion evidence and complaint records.

"User Content" means any information, data, text, image, video, file, document, review, message, logo, business information or other content uploaded, sent, created or stored by a User through Liztty.

"Fees" means any subscription fees, platform fees, service fees, booking fees, call-out fees, cancellation fees, payment processing fees, commission, add-on fees or other amounts payable through or in connection with Liztty.

"Australian Consumer Law" means Schedule 2 to the Competition and Consumer Act 2010 (Cth).

2. About Liztty

Liztty provides software and related tools to help Users manage service jobs, bookings, quotes, customers, providers, staff, communications, invoices, payments and business operations.

Depending on the Job, Liztty may operate as:

  • a software provider;
  • a booking and job management platform;
  • a communication and workflow tool;
  • a facilitator between Customers and Providers;
  • a service coordination platform;
  • a payment coordination tool;
  • an operations platform for associated businesses; or
  • where expressly stated, the direct supplier or manager of a service.

The role Liztty plays may depend on the booking confirmation, quote, invoice, job details, service category or agreement between the parties.

3. Acceptance of these Terms

You accept these Terms when you:

  • create a Liztty account;
  • access or use the Platform;
  • accept an invitation to an account;
  • submit a booking or quote request;
  • accept or perform a Job;
  • communicate through Liztty;
  • make or receive payment through Liztty;
  • continue using Liztty after being notified of updated Terms.

If you do not agree with these Terms, you must not use Liztty.

4. Additional Terms

Some features, services or transactions may be subject to additional terms, including:

  • Privacy Policy;
  • Provider Agreement;
  • Customer Booking Terms;
  • Payment Terms;
  • Subscription Plan Terms;
  • Acceptable Use Policy;
  • Service Category Rules;
  • App Store or Google Play terms;
  • third-party payment processor terms;
  • promotional offer terms;
  • enterprise or custom contract terms.

If there is inconsistency, the more specific terms apply to the relevant feature or transaction, unless stated otherwise.

5. Changes to these Terms

We may update these Terms from time to time.

Where changes are material, we will take reasonable steps to notify affected Users, such as by email, in-app notice or website notice.

Changes will not unfairly remove rights already accrued to you. If you do not agree with updated Terms, you may stop using Liztty and cancel your account, subject to any existing payment obligations, minimum term, accepted Job, booking or lawful fee already incurred.

6. Eligibility and Authority

To use Liztty, you must:

  • be at least 18 years old, unless using the Platform under supervision of an authorised business account;
  • have legal capacity to enter into contracts;
  • provide accurate information;
  • use the Platform for lawful purposes;
  • comply with all applicable laws and regulations.

If you use Liztty for a business or organisation, you represent that you have authority to act for that business or organisation.

7. Account Registration

You may need to create an account to access certain Liztty features.

You agree to:

  • provide accurate, current and complete information;
  • keep your account details updated;
  • keep login credentials secure;
  • not share your login with unauthorised persons;
  • immediately notify Liztty of suspected unauthorised access;
  • accept responsibility for activity under your account, unless caused by Liztty's breach of law or negligence.

We may refuse, suspend or cancel an account if we reasonably believe the account is inaccurate, misleading, fraudulent, unsafe, unlawful or in breach of these Terms.

8. Account Holder Responsibilities

An Account Holder is responsible for:

  • managing access to the account;
  • inviting and removing Team Members;
  • assigning appropriate permissions;
  • ensuring Team Members comply with these Terms;
  • monitoring Jobs, quotes, invoices and messages sent through the account;
  • ensuring Customer information is collected and used lawfully;
  • paying all Fees incurred through the account;
  • ensuring business, licensing, insurance, tax and employment obligations are met;
  • removing access when a Team Member leaves or no longer requires access.

The Account Holder is responsible for actions taken by Team Members, Providers or other invited users within the account, except to the extent caused by Liztty's own breach, negligence or system error.

9. Team Member Access

Team Members may access Liztty only as authorised by the Account Holder.

Team Members must:

  • use their own login where required;
  • not share passwords;
  • access only information needed for their role;
  • keep Customer and Job Data confidential;
  • follow the Account Holder's lawful instructions;
  • not export, copy or misuse data;
  • comply with privacy, safety and communication requirements;
  • stop using the account when authority ends.

Liztty may suspend Team Member access if we reasonably believe there is a security, privacy, misuse, safety or legal risk.

10. Licence to Use Liztty

Subject to these Terms, Liztty grants you a limited, revocable, non-exclusive, non-transferable right to access and use the Platform for lawful personal, business or operational purposes.

You must not:

  • copy, sell, rent, lease, sublicense or resell Liztty;
  • reverse engineer, decompile or attempt to extract source code;
  • bypass security or access controls;
  • scrape or harvest data without permission;
  • create competing software using confidential Platform information;
  • interfere with Platform performance;
  • use Liztty to transmit viruses, malware or harmful code;
  • use Liztty for unlawful, misleading, abusive or fraudulent activity.

All rights not expressly granted remain with Liztty.

11. Ownership of the Platform

Liztty owns or licenses all rights in the Platform, including:

  • software;
  • source code;
  • design;
  • workflows;
  • user interface;
  • databases;
  • branding;
  • logos;
  • documents;
  • templates;
  • business processes;
  • analytics systems;
  • platform content.

Nothing in these Terms transfers ownership of Liztty intellectual property to you.

12. User Content and Job Data

You retain ownership of User Content and Job Data you lawfully upload, create or submit through Liztty.

You grant Liztty a licence to access, use, host, store, copy, process, transmit, display, back up, modify format, analyse and disclose User Content and Job Data as reasonably necessary to:

  • provide the Platform;
  • manage Jobs;
  • process bookings and payments;
  • send communications;
  • provide support;
  • maintain security;
  • investigate complaints;
  • comply with law;
  • improve the Platform;
  • generate de-identified or aggregated business insights.

You must ensure you have the right to upload, disclose and use any User Content or Job Data you provide to Liztty.

13. Accuracy of Information

You agree that all information you provide must be accurate, complete and not misleading.

This includes:

  • names;
  • phone numbers;
  • email addresses;
  • job addresses;
  • access details;
  • service descriptions;
  • photos;
  • quotes;
  • invoices;
  • provider credentials;
  • licences;
  • insurance documents;
  • ABN details;
  • payment information.

Liztty may rely on information provided by Users. We are not responsible for loss caused by inaccurate, incomplete or misleading information provided by a User, except where required by law.

14. Customer Responsibilities

Customers must:

  • provide accurate job details;
  • provide correct address and contact information;
  • disclose relevant access issues, stairs, parking, lifts, pets, safety concerns or site restrictions;
  • ensure someone authorised is available at the agreed time if required;
  • ensure items, parts, manuals and materials are ready where relevant;
  • ensure the work area is safe, clean and accessible;
  • secure valuables, fragile items, children and pets;
  • obtain approvals from landlords, building managers, strata or owners where needed;
  • pay agreed Fees;
  • communicate respectfully;
  • notify Liztty promptly of any issue, complaint or damage claim.

A Customer must not request unlawful, unsafe or unlicensed work.

15. Business User Responsibilities

Business Users must:

  • comply with all laws applying to their business;
  • ensure staff and contractors are properly trained;
  • hold required registrations, licences, permits and insurance;
  • comply with tax, employment, contractor and workplace laws;
  • provide accurate business information;
  • comply with privacy and spam laws when using Customer information;
  • honour quotes, bookings and commitments made through Liztty;
  • not mislead Customers;
  • not misuse Liztty communications or data;
  • promptly handle Customer complaints and rectification requests.

Business Users remain responsible for their own business operations, Customers, staff, contractors, taxes and legal obligations.

16. Provider Responsibilities

Providers must:

  • accept only Jobs they are qualified, licensed, insured and capable of performing;
  • read Job details before accepting;
  • attend at the agreed time or promptly notify of delays;
  • act professionally and respectfully;
  • carry appropriate tools and equipment;
  • perform work with due care and skill;
  • comply with safety requirements;
  • protect Customer property;
  • report damage, hazards, missing parts or scope issues immediately;
  • take before-and-after photos where required;
  • not bring unauthorised persons to a Customer's property;
  • not perform licensed work unless properly licensed;
  • not pressure Customers for cash, tips, private work or off-platform arrangements;
  • not harass, threaten, discriminate against or abuse any User;
  • not use Customer data for unrelated purposes.

A Provider is responsible for their own tools, transport, insurance, licences, tax, superannuation, workers, subcontractors and business compliance unless otherwise agreed in writing.

17. Independent Contractor Status

Unless expressly agreed in writing, Providers are independent contractors and are not employees, agents, partners or representatives of Liztty.

Nothing in these Terms creates an employment relationship, partnership, joint venture or agency relationship between Liztty and any Provider.

Providers are responsible for determining how to perform accepted work, subject to job requirements, safety obligations, Customer instructions, applicable law and Liztty's platform rules.

18. Licensed and Regulated Work

Certain work must only be performed by properly licensed or authorised persons.

This may include, depending on the jurisdiction and work type:

  • electrical work;
  • plumbing work;
  • gasfitting;
  • building work;
  • structural work;
  • waterproofing;
  • asbestos-related work;
  • security work;
  • specialist trade work;
  • high-risk work.

Users must not request, accept, advertise or perform regulated work unless the required licences, permits and insurances are held.

Liztty may cancel, suspend, reassign or refuse any Job if we reasonably believe it involves regulated work that cannot lawfully or safely proceed.

19. Work Health and Safety

All Users must act safely and comply with applicable work health and safety laws.

Customers must provide a reasonably safe site. Providers and Business Users must take reasonable care for their own safety and the safety of others.

A Job may be refused, paused, rescheduled or cancelled if:

  • the site is unsafe;
  • access is dangerous;
  • required equipment is unavailable;
  • the work is outside scope;
  • the work requires a licence not held by the Provider;
  • there is threatening, abusive or unsafe behaviour;
  • the Provider reasonably believes continuing would create a safety risk.

No cancellation fee will be charged where prohibited by law. Where a safety issue is caused by incomplete or inaccurate information provided by a User, reasonable fees may apply.

20. Quotes, Estimates and Bookings

A quote or estimate is based on the information available at the time it is provided.

A quote may change if:

  • the Job description is inaccurate or incomplete;
  • the site conditions are different;
  • additional work is requested;
  • materials or parts are missing;
  • access is more difficult than disclosed;
  • parking, stairs, lifts or carrying distance were not disclosed;
  • regulated work is required;
  • the Customer changes the scope;
  • the Provider discovers damage, defects or safety issues.

Unless stated otherwise, a booking is not confirmed until accepted by Liztty, the Business User or the Provider and any required deposit, prepayment or confirmation step is completed.

21. Job Scope

The scope of each Job is limited to what is stated in the booking, quote, work order, invoice or written confirmation.

Unless expressly included, a Job does not include:

  • additional labour;
  • extra items;
  • rubbish removal;
  • moving heavy items;
  • wall mounting;
  • drilling;
  • electrical work;
  • plumbing work;
  • repairs to defective products;
  • supplying missing parts;
  • parking fees;
  • tolls;
  • specialist tools;
  • materials;
  • return visits.

Additional work may require a revised quote or additional Fees.

22. Furniture Assembly and Installation

For furniture assembly, flat-pack assembly and related installation Jobs:

  • the Customer is responsible for ensuring all parts, hardware and instructions are available;
  • manufacturer defects, missing parts or incorrect parts are not the Provider's responsibility unless caused by the Provider;
  • weak, defective or low-quality materials may increase the risk of damage;
  • wall mounting, anchoring or drilling must be specifically requested and may require suitable wall type, fixtures and authorisation;
  • the Customer must disclose stairs, access limitations, heavy items or restricted parking;
  • assembly does not include moving boxes, disposal, delivery, repairs or modifications unless expressly included.

Nothing in this section limits rights under Australian Consumer Law.

23. Handyman and Trade-Related Services

For handyman, repair and maintenance Jobs:

  • the scope must be clearly agreed before work starts;
  • materials are not included unless stated;
  • additional defects discovered during work may require a revised quote;
  • Providers must not perform regulated trade work without required licences;
  • Customers must disclose known hazards or defects;
  • Liztty may require photos before confirming a booking;
  • work may be refused if unsafe, unlawful or outside Provider capability.

24. Cleaning, Delivery and Removal Services

For cleaning, delivery, removal or similar Jobs:

  • Customers must provide accurate item descriptions, access details and condition information;
  • fragile, valuable, dangerous, illegal or restricted items must be disclosed;
  • Providers may refuse unsafe, unhygienic, hazardous or unlawful items or premises;
  • extra waiting time, stairs, heavy lifting, parking, tolls or additional items may incur additional Fees;
  • proof of pickup, delivery or completion may be recorded through photos, signatures, notes or GPS data.

25. Cancellations, Rescheduling and Failed Visits

Cancellation, rescheduling or failed visit Fees may apply where permitted by law and where the fee reflects reasonable costs or loss incurred.

A failed visit may occur if:

  • the Customer is not present or contactable;
  • access is unavailable;
  • the address is incorrect;
  • the item has not arrived;
  • required parts are missing;
  • the Job is materially different from the booking;
  • the site is unsafe;
  • parking or access was not disclosed;
  • the Customer cancels after a Provider has been assigned or dispatched;
  • the Customer requests work outside the agreed scope and does not approve a revised quote.

Any applicable Fee should be disclosed in the booking, quote, invoice or service terms.

Nothing in these Terms excludes or limits rights under Australian Consumer Law.

26. Payments

You agree to pay all Fees applicable to your use of Liztty and any Jobs booked, accepted, managed or completed through the Platform.

Fees may include:

  • subscription fees;
  • platform fees;
  • booking fees;
  • service fees;
  • commission;
  • call-out fees;
  • cancellation fees;
  • failed visit fees;
  • payment processing fees;
  • add-on feature fees;
  • SMS, email, call or usage fees;
  • storage or integration fees;
  • late payment fees where lawful;
  • GST and other taxes where applicable.

Fees are payable in accordance with the invoice, subscription plan, booking confirmation or payment terms shown at the time.

27. Subscriptions

If Liztty offers subscription plans:

  • subscription Fees are payable in advance unless stated otherwise;
  • plans may be monthly, annual or custom;
  • features may vary by plan;
  • usage limits may apply;
  • unused features or credits may not be refundable unless required by law;
  • subscriptions may renew automatically if clearly disclosed and accepted;
  • cancellation takes effect at the end of the current billing period unless stated otherwise or required by law;
  • downgrades may reduce access to features, storage or users.

We will not impose hidden charges. Material subscription terms should be clearly disclosed before purchase.

28. Payment Processing

Liztty may use third-party payment processors such as Stripe or other providers.

By making or receiving payments through Liztty, you agree that:

  • payment processing may be provided by a third party;
  • you may need to accept the payment processor's terms;
  • payment information may be collected and processed by the payment processor;
  • Liztty is not a bank, deposit-taking institution or financial adviser;
  • payouts may be delayed due to fraud checks, chargebacks, compliance checks, banking delays or processor rules;
  • Liztty may deduct applicable Fees before payout where authorised;
  • chargebacks, disputes, reversals and failed payments may be recovered from the responsible User where lawful.

29. Deposits, Prepayments and Payment Release

Liztty may require a deposit, prepayment, card authorisation or initial payment to confirm a Job.

Where Liztty holds or coordinates payment release, release may depend on:

  • Job completion;
  • Customer confirmation;
  • provider completion evidence;
  • dispute status;
  • fraud or chargeback risk;
  • applicable refund obligations;
  • payment processor rules;
  • any escrow or payment release process disclosed at booking.

Liztty may hold payment temporarily where there is a reasonable dispute, suspected fraud, safety concern, chargeback, complaint or legal issue.

30. Refunds and Remedies

Refunds, credits, rework, repairs, replacements or cancellations will be assessed based on:

  • the applicable booking terms;
  • the work performed;
  • the evidence available;
  • whether the issue is minor or major;
  • whether rectification is reasonable;
  • applicable law, including Australian Consumer Law.

Nothing in these Terms excludes, restricts or modifies any consumer guarantee, right or remedy that cannot lawfully be excluded.

Where a service fails to meet a consumer guarantee, the Customer may be entitled to a remedy under Australian Consumer Law.

31. Australian Consumer Law

If you are a consumer under Australian Consumer Law, you have rights that cannot be excluded.

For services, these may include guarantees that services will be:

  • provided with due care and skill;
  • fit for any disclosed purpose;
  • supplied within a reasonable time where no time is agreed.

Nothing in these Terms excludes, restricts or modifies any guarantee, right or remedy under Australian Consumer Law or any other law that cannot lawfully be excluded.

Any limitations in these Terms apply only to the maximum extent permitted by law.

32. Damage, Defects and Complaints

A User must report damage, defective work or service issues as soon as reasonably possible after becoming aware of the issue.

Liztty may request:

  • photos;
  • videos;
  • job notes;
  • messages;
  • invoices;
  • inspection details;
  • provider response;
  • product information;
  • proof of loss.

Where appropriate, Liztty may assist with:

  • investigation;
  • communication between parties;
  • arranging rectification;
  • offering credit or refund;
  • escalating to insurance;
  • suspending payment release;
  • removing unsafe or non-compliant Providers.

A Customer should allow a reasonable opportunity to inspect and rectify an issue where lawful and appropriate.

Liztty is not responsible for pre-existing damage, manufacturer defects, missing parts, normal wear and tear, weak materials, incorrect Customer information or damage caused by a User's own actions, except to the extent required by law or caused by Liztty's breach, negligence or direct responsibility.

33. Reviews and Ratings

Users may be able to submit reviews, ratings or feedback.

Reviews must be genuine, accurate and based on real experience.

Users must not:

  • submit fake reviews;
  • arrange misleading reviews;
  • offer incentives only for positive reviews;
  • hide commercial relationships;
  • threaten negative reviews to obtain improper benefits;
  • post abusive, discriminatory or defamatory content;
  • impersonate another person.

Liztty may moderate, remove or refuse reviews that are fake, abusive, irrelevant, unlawful, misleading, private, defamatory or otherwise in breach of these Terms.

34. Communications Through Liztty

Liztty may enable communications by:

  • SMS;
  • email;
  • app notifications;
  • phone calls;
  • chat;
  • quote messages;
  • booking reminders;
  • automated updates;
  • review requests;
  • support messages.

You consent to receive transactional communications necessary to provide the Platform and manage Jobs.

Transactional communications may include:

  • account alerts;
  • booking confirmations;
  • provider assignment updates;
  • quote notifications;
  • payment reminders;
  • job reminders;
  • cancellation notices;
  • safety notices;
  • complaint updates;
  • password or security alerts.

35. Marketing Communications

Liztty may send marketing communications only where permitted by law.

Marketing communications may include:

  • promotions;
  • discounts;
  • rebooking campaigns;
  • new feature announcements;
  • service recommendations;
  • partner offers.

Where required, Liztty will obtain consent and provide a functional unsubscribe method.

Users must not use Liztty's communication tools to send spam, unlawful marketing, misleading promotions or messages without required consent.

Business Users are responsible for ensuring that any marketing messages they send through Liztty comply with applicable spam, privacy and consumer laws.

36. Call Recording

Liztty may record or monitor calls where lawful for:

  • quality assurance;
  • training;
  • dispute resolution;
  • safety;
  • fraud prevention;
  • compliance;
  • complaint investigation.

Where required by law, Liztty will provide notice or obtain consent.

Users must not record calls or communications through Liztty unlawfully.

37. Photos, Videos and Evidence

Liztty may allow or require Users to upload photos, videos, signatures or completion evidence.

This may include:

  • before photos;
  • after photos;
  • access photos;
  • damage photos;
  • delivery proof;
  • customer signatures;
  • item condition photos;
  • safety issue photos;
  • job progress photos.

Users must not upload photos or videos that are unlawful, invasive, offensive, misleading or unrelated to the Job.

Providers must avoid capturing unnecessary personal, private or sensitive information where possible.

38. Privacy

Liztty handles personal information in accordance with its Privacy Policy.

Personal information may include:

  • names;
  • phone numbers;
  • email addresses;
  • addresses;
  • photos;
  • location information;
  • payment information;
  • messages;
  • job details;
  • identity documents;
  • licences;
  • insurance records;
  • device and usage data.

By using Liztty, you agree that Liztty may collect, use, disclose and store personal information as described in the Privacy Policy.

39. Customer Data and Business Account Data

Where a Business User uploads Customer information into Liztty, the Business User confirms that:

  • it has authority to collect and use that information;
  • it has provided any required privacy notice;
  • it has obtained any required consent;
  • the information is accurate and relevant;
  • it will not upload unnecessary sensitive information;
  • it will not use Liztty to misuse Customer data.

Liztty may process Customer data to provide the Platform and related services.

40. Overseas Access and Third-Party Service Providers

Liztty may use third-party service providers to operate the Platform, including hosting, storage, analytics, communications, payment processing, maps, email, SMS, customer support, security, AI tools and app infrastructure.

Some providers, systems, staff, contractors or support teams may be located outside Australia.

Liztty will take reasonable steps required by applicable law when disclosing personal information overseas.

Business Users acknowledge that using cloud software may involve overseas storage, processing or support access.

41. Data Security

Liztty will take reasonable steps to protect User Content, Job Data and personal information from misuse, interference, loss, unauthorised access, modification or disclosure.

Security measures may include:

  • access controls;
  • encryption where appropriate;
  • authentication;
  • monitoring;
  • backups;
  • staff access controls;
  • audit logs;
  • secure hosting;
  • incident response processes.

No system is completely secure. Users must also take reasonable steps to protect their accounts, devices, passwords and access permissions.

42. Data Breach Response

If Liztty becomes aware of a data breach affecting personal information, Liztty will assess the breach and take reasonable steps to contain, investigate and respond.

Where required by law, Liztty will notify affected individuals and/or relevant regulators.

Business Users must promptly notify Liztty if they become aware of unauthorised access, disclosure, loss or misuse of data connected to Liztty.

43. Data Retention and Deletion

Liztty may retain data for as long as reasonably necessary for:

  • providing the Platform;
  • account management;
  • legal compliance;
  • tax and accounting records;
  • dispute resolution;
  • fraud prevention;
  • insurance claims;
  • safety investigations;
  • business records;
  • backup and disaster recovery.

When an account is closed, Liztty may delete, anonymise or retain data in accordance with its Privacy Policy, legal obligations and operational requirements.

Users should export required data before closing an account where export tools are available.

44. Third-Party Integrations

Liztty may allow integrations with third-party services, including:

  • payment processors;
  • accounting software;
  • CRM systems;
  • calendar tools;
  • map services;
  • SMS providers;
  • email providers;
  • VOIP providers;
  • AI services;
  • storage providers;
  • app stores;
  • analytics tools.

Third-party services are governed by their own terms and privacy policies.

Liztty is not responsible for third-party systems, outages, data handling, fees, errors or security incidents, except to the extent required by law or caused by Liztty's own breach or negligence.

If you enable an integration, you authorise Liztty to share relevant data with that integration as needed.

45. AI and Automation Features

Liztty may include AI, automation, voice, text generation, job description assistance, quote assistance, customer support tools or workflow automation.

AI and automation outputs may be inaccurate, incomplete or unsuitable.

Users are responsible for reviewing and approving outputs before relying on them, sending them to Customers or using them for quotes, invoices, legal documents, safety instructions or service decisions.

Liztty does not guarantee that AI or automation outputs are accurate, lawful, complete or suitable for every situation.

46. Prohibited Use

You must not use Liztty to:

  • break the law;
  • commit fraud;
  • mislead Customers or Providers;
  • send spam;
  • harass or threaten anyone;
  • discriminate unlawfully;
  • upload illegal or harmful content;
  • impersonate another person;
  • create fake accounts;
  • post fake reviews;
  • bypass platform Fees;
  • take Customers or Providers off-platform where prohibited;
  • scrape data;
  • reverse engineer the Platform;
  • interfere with security;
  • perform unlicensed work;
  • arrange unsafe or unlawful services;
  • misuse personal information;
  • upload malware;
  • damage Liztty's reputation or systems.

47. Off-Platform Dealing

Where Liztty introduces, assigns, connects or manages a Customer, Provider or Job, Users must not use that connection to avoid Liztty Fees, payment processes or platform rules.

Unless Liztty gives written permission, Users must not:

  • solicit direct cash payments to avoid Fees;
  • move a Liztty Job off-platform;
  • use Liztty contact details for unrelated marketing;
  • bypass payment release processes;
  • privately subcontract a Liztty Job without disclosure;
  • encourage Customers or Providers to avoid Liztty.

Liztty may suspend or terminate accounts involved in fee avoidance or off-platform misuse.

48. Suspension and Restriction

Liztty may suspend, restrict or disable access where we reasonably believe:

  • there is non-payment;
  • there is fraud or chargeback risk;
  • a User breached these Terms;
  • a User is misusing data;
  • a User is sending spam;
  • there is a safety risk;
  • a Provider is unlicensed or uninsured where required;
  • there is abusive or unlawful conduct;
  • there is a security risk;
  • suspension is required by law or a third-party provider.

Where reasonable, Liztty will give notice and an opportunity to respond, unless immediate action is needed for safety, security, fraud prevention, legal compliance or protection of others.

49. Termination

You may stop using Liztty at any time.

An Account Holder may request account closure, subject to:

  • unpaid Fees;
  • active Jobs;
  • pending payouts;
  • unresolved disputes;
  • legal retention requirements;
  • fraud or chargeback investigations;
  • minimum subscription terms.

Liztty may terminate access if a User materially breaches these Terms, repeatedly breaches these Terms, fails to pay Fees, misuses the Platform, creates legal risk or engages in unsafe, fraudulent or abusive conduct.

Termination does not affect rights and obligations that accrued before termination.

50. Service Availability

Liztty aims to provide reliable access but does not guarantee uninterrupted, error-free or continuous availability.

Access may be affected by:

  • maintenance;
  • updates;
  • outages;
  • internet failures;
  • device issues;
  • third-party service failures;
  • payment processor issues;
  • app store issues;
  • cyber incidents;
  • force majeure events.

Liztty may change, suspend, remove or improve features from time to time. We will try to avoid unreasonable disruption where practical.

51. Support

Liztty may provide support through email, phone, chat, help centre, app messaging or other channels.

Support availability may vary by plan, location, feature or issue type.

Liztty does not guarantee immediate support unless a written service level agreement applies.

52. Beta Features

Liztty may release beta, trial, experimental or early-access features.

Beta features may be incomplete, unstable or changed without notice.

You use beta features at your own risk and should not rely on them for critical business operations unless Liztty confirms otherwise in writing.

53. Taxes

Users are responsible for their own tax obligations, including:

  • GST;
  • income tax;
  • PAYG;
  • contractor payments;
  • payroll tax;
  • superannuation;
  • invoices;
  • receipts;
  • business records.

Liztty may collect GST or other taxes where required by law.

Providers and Business Users are responsible for determining whether they must register for GST and issue tax invoices.

54. Insurance

Providers and Business Users are responsible for maintaining appropriate insurance for their services, which may include:

  • public liability insurance;
  • professional indemnity insurance;
  • workers compensation;
  • vehicle insurance;
  • tools insurance;
  • contractor insurance;
  • other industry-specific insurance.

Liztty may request proof of insurance.

Verification of insurance does not guarantee that a claim will be accepted or that all loss is covered.

55. Verification

Liztty may conduct checks on Providers or Business Users, including:

  • identity checks;
  • ABN checks;
  • licence checks;
  • insurance checks;
  • police checks;
  • right-to-work checks;
  • document review;
  • reference checks;
  • customer feedback review.

Verification means only that certain checks may have been conducted at a point in time. It does not guarantee future conduct, work quality, availability, suitability or compliance.

56. Marketplace and Platform Disclaimer

Where Liztty acts only as a platform, facilitator, booking tool or software provider, the Provider or Business User performing the Job is responsible for the performance of that Job.

Where Liztty is expressly identified as the direct supplier of the service, Liztty will be responsible for its obligations as supplier under applicable law.

Nothing in this section limits non-excludable consumer rights.

57. Limitation of Liability

To the maximum extent permitted by law, Liztty is not liable for:

  • indirect loss;
  • loss of profit;
  • loss of revenue;
  • loss of goodwill;
  • loss of opportunity;
  • business interruption;
  • loss of data caused by User failure to back up or export data;
  • third-party service failures;
  • Customer or Provider conduct;
  • inaccurate information supplied by Users;
  • off-platform dealings;
  • unlicensed work performed without Liztty's knowledge;
  • misuse of the Platform.

Where Liztty's liability cannot be excluded but can be limited, Liztty's liability is limited, at our option and where lawful, to:

  • resupplying the relevant service;
  • paying the cost of resupplying the service;
  • refunding the Fees paid for the affected service;
  • another remedy required by law.

This limitation does not exclude liability for fraud, wilful misconduct, gross negligence, personal injury, death or liability that cannot legally be excluded.

58. Indemnity

You agree to indemnify Liztty against losses, claims, damages, liabilities, costs and expenses arising from:

  • your breach of these Terms;
  • your unlawful conduct;
  • your misuse of the Platform;
  • your inaccurate or misleading information;
  • your misuse of personal information;
  • your breach of privacy or spam laws;
  • your unlicensed or unsafe work;
  • your employment, contractor or tax obligations;
  • your dispute with another User;
  • your off-platform dealing;
  • your User Content;
  • your failure to obtain required consents or permissions.

This indemnity is reduced to the extent the loss is caused by Liztty's breach, negligence or unlawful conduct.

59. Confidentiality

Users may access confidential information through Liztty, including:

  • Customer details;
  • business records;
  • pricing;
  • quotes;
  • internal job notes;
  • provider details;
  • payment information;
  • platform workflows;
  • technical information;
  • non-public business information.

Users must keep confidential information confidential and use it only for authorised purposes.

This obligation continues after account closure or termination.

60. Non-Solicitation and Platform Protection

Where lawful and reasonable, Providers, Team Members and Business Users must not use Liztty to improperly solicit Customers, staff, Providers or business relationships introduced through Liztty for the purpose of avoiding Liztty or damaging Liztty's business.

This clause does not prevent fair competition, lawful employment rights or a Customer's freedom to choose a provider where the law does not permit restriction.

61. App Stores

If you download Liztty through the Apple App Store, Google Play Store or another app marketplace, your use of the app may also be subject to that store's terms.

App store providers are not responsible for Liztty's services, support, claims or content, except as required by their own terms or applicable law.

Subscription cancellation and refunds for app-store purchases may need to be managed through the relevant app store.

62. Electronic Communications and Signatures

You consent to receiving notices, agreements, invoices, receipts, disclosures and other communications electronically.

Electronic communications may be sent by:

  • email;
  • SMS;
  • app notification;
  • dashboard notice;
  • website notice;
  • phone;
  • other contact methods provided by you.

You agree that electronic acceptance, digital signatures, checkbox acceptance, app confirmations, SMS confirmations and online approvals may be legally effective where permitted by law.

63. Dispute Resolution

Before starting court proceedings, a party must try to resolve the dispute in good faith.

The process is:

  • notify the other party of the issue;
  • provide relevant evidence;
  • allow a reasonable time for response;
  • attempt practical resolution;
  • escalate to management if needed.

For service complaints, Liztty may review:

  • booking records;
  • quotes;
  • invoices;
  • photos;
  • messages;
  • call records;
  • provider response;
  • customer response;
  • payment records.

Nothing prevents a consumer from contacting a regulator, Fair Trading body, tribunal or court where they have a legal right to do so.

64. Force Majeure

Liztty is not responsible for delay or failure caused by events beyond reasonable control, including:

  • natural disasters;
  • storms;
  • floods;
  • fires;
  • pandemics;
  • government restrictions;
  • strikes;
  • power outages;
  • internet failures;
  • cyberattacks;
  • payment network failures;
  • third-party platform outages;
  • supply chain disruption;
  • emergency events.

65. Notices

Liztty may send notices to the email address, phone number or account contact details provided by you.

You are responsible for keeping your contact details current.

A notice is taken to be received when sent, unless there is evidence it was not delivered.

66. Assignment

You must not transfer your account or rights under these Terms without Liztty's written consent.

Liztty may assign or transfer its rights and obligations as part of a merger, acquisition, restructure, sale of business, asset transfer or corporate reorganisation, provided this does not unfairly reduce your rights.

67. Severability

If any part of these Terms is invalid, unlawful or unenforceable, that part will be read down or removed to the extent necessary, and the remaining Terms will continue to apply.

68. No Waiver

If Liztty does not enforce a right immediately, this does not mean Liztty waives that right.

A waiver must be in writing.

69. Entire Agreement

These Terms, together with any applicable additional terms, policies, booking terms, quotes, invoices and written agreements, form the agreement between Liztty and the User for the relevant use of the Platform or Job.

70. Governing Law

These Terms are governed by the laws of New South Wales, Australia.

The parties submit to the non-exclusive jurisdiction of the courts of New South Wales and applicable Australian courts.

If you are a consumer, this clause does not remove any rights you may have under laws that apply in your location.
